Terms and conditions of supply 2017 and explanation of terms

The terms and conditions below apply to all events booked through The Adrenalin Jungle Ltd.
In these terms and conditions “we” & “us” means The Adrenalin Jungle Ltd, Deerdale Lane, Bilsthorpe, Nottingham NG22 8SY. Reg No 5721994
“You” means the “Person” who has placed the booking either for yourself or on behalf another person with The Adrenalin Jungle Ltd. You must be aware that on placing the booking you / they are agreeing to comply with these terms & conditions and on behalf of every member of their group. 
If the booking is placed on behalf of a limited company “you” means the Agent operating on behalf of the company.
“Event” means all aspects of an activity booking with The Adrenalin Jungle Ltd be it active, social or relaxation.
Events booked by telephone are still bound by The Adrenalin Jungle Ltd.’s Terms & Conditions.

Clause 1 - Booking and Payment Terms
1.1 Any booking or quotation will not be deemed as confirmed until such time as written confirmation along with a purchase order (if relevant) has been acknowledged as received by us. 
1.2 For all events 100% of the amount due as stated on the provisional reservation is to be cleared into our account on or before the date stated on the provisional reservation.
1.3 If any or all payments under this agreement are not made when due to us, we will be entitled to add interest on the amount that is overdue at a rate of four percent (4%) above the prevailing base rate of the Natwest Bank Plc calculated on a daily basis without prejudice to any other rights or remedies that we may have. You will also pay all charges and costs we reasonably incur in the recovery of the outstanding monies. 
1.4 Where group numbers fall below the minimum group sizes stipulated on the Adrenalin Jungle web site, The Adrenalin Jungle Ltd have the right to use their discretion and request payment based on the minimum group size rather than actual participant numbers booked. 
1.5 For large group bookings specifically in peak periods where multiple event slots are being held we reserve the right to ask you at any time to check on your latest confirmed group numbers in order for us to release event slots that will no longer be required.



Clause 2 - Cancellation AND AMMENDMENT Policy
In order to provide the very best service to all of our clients the following cancellation policy applies.
2.1 Cancellations By You
2.11 We must be notified in writing of any cancellations or changes to an event booking immediately by the event organiser.
2.12 On receipt of your written cancellation or changes the following charges will apply:
Cancel without charge if cancelation is made prior to he agreed deposit due date
Cancel with charge if cancelation is made after the deposit has been paid the deposit payment is lost but the event balance is not
The cancellation is only deemed accepted by us when you received written confirmation back from us acknowledging the cancellation.

2.2 Booking Amendments By You
2.21 Where a booking amendment increases in the number attending, or the cost of the event increases, an invoice will be raised from the date of notification & the normal payment terms & conditions will apply. 
2.22 If the increase occurs inside the timeline specified above (less than 13 days) payment will be required in line with Clause 1.
Where a booking decreases in number or cost prior to the deposit due date we will amend without charge. 
Where a booking decreases in number or cost after the deposit has been paid any deposits paid for guest no longer attending will be lost however there event balance will be cancelled.
2.3 Cancellation or Amendments By Us

2.31 We reserve the right to cancel, terminate or switch the event if a change in group size makes it impractical or uneconomical for the event to run.
2.32 We reserve the right to cancel, terminate or switch to an alternative activity if for any reason preceding or during any part of the event the customer’s safety is threatened, including adverse weather conditions.
2.33 If cancellation occurs we will make every effort to reschedule the event to another date. However due to the fact that the Activity Centre is located outdoors, we are not obliged to give any refunds in cases of adverse weather conditions as alternative dates will always be offered.

2.34 Refunds will not apply in the following circumstances; war or threat of war, riots, civil unrest, terrorism, industrial disputes, natural or nuclear disaster, fire, technical problems or any other occurrence beyond our control.
2.35 Unless we cancel because of the above circumstances we will refund all payments made by you to us & will have no further liability to you.



Clause 3 - Late Arrival Policy
3.1 Because all events run to a strict timetable we ask that you inform all your guests to be with us a minimum of 15 minutes before event start time unless otherwise stated. Late arrival might result in one of the following - reduction of time on event, total loss of event or an incurred charge to cover additional staffing costs caused by events running over. 
3.2 Where an event time is reduced or the event is lost due to late arrival, no refunds will be due.

Clause 4 - Liability
4.1 All of our events carry an element of risk and we strongly advise you recommend your clients to take personal accident cover. If you / the client choose not to take such cover we assume you are happy to take the risk of being uninsured.
4.2 If the activity is being organised by an employer it is their responsibility to ensure that they have made all relevant checks relating to the event with the company’s insurers and that if required have requested and received copies of any documentation to comply with any requirements laid down by their insurer to enable the participation of the attendees.
4.3 The Adrenalin Jungle Ltd will only accept liability if a failure in their duty of care results in injury or death but only to the extent that is obliged to under English Law.
4.4 The Adrenalin Jungle Ltd shall not be liable for any injury, death, loss or damage caused by another participant, nor will it be liable for any uninsured losses of your property, nor for any illness.

Clause 5 – COMPLAINTS
5.1 The Adrenalin Jungle Ltd shall only acknowledge receipt of and / or act on complaints received within 14 days of the event date. 
5.2 The details of the complaint must be received in writing / via email and be made by You the Agent and not the individual customer / participant or any third party.
Clause 6 - The Adrenalin Jungle Ltd Code of Conduct
Due to the nature of many events run by The Adrenalin Jungle Ltd all participants must abide by the following rules:
6.1 All guests must conduct themselves in a courteous, proper and safe manner at all times.
6.2 All guests must listen and follow the instructions given by our staff or contractors.
6.3 All guests must dress in the correct clothing and use all safety equipment as instructed.
6.4 All guests must agree to compensate us or our contractors for any costs incurred due to improper behavior during your time at the Activity Centre.

6.5 All guests must inform us of any medical conditions that may affect their participation in any activity prior to the event commencing.
6.6 All guests must take responsibility for removing themselves from any event or element of an event if they do not feel competent to participate.
6.7 Under no circumstances will guests be allowed to participate in an activity if it is believed that they are under the influence of alcohol or drugs.

6.8 The Adrenalin Jungle Ltd reserve the right to terminate the whole event or any individual activity if, in our opinion the behavior of the group or an individual is threatening the safety or enjoyment of any other persons. The group or individuals involved will not be entitled to any refund.
